Adoption, in relation to civil engineering, is the formal process where newly built infrastructure, like roads, junctions and drainage, is ‘adopted’ or taken over by a public authority so it becomes their responsibility to maintain long-term. It is important that developers, landowners, and funders will be able to have their new development’s infrastructure adopted for several reasons, including a condition of planning approval, needed for site sales and funding, it reduces their long-term maintenance costs and responsibilities and protects them from future legal and access issues.

The adoption process commonly applies to

  • Roads and footways that are adopted by the Local Highway Authority under a Section 38 Agreement
  • Surface water & foul sewers are adopted by the Water Authority under a Section 104
  • SuDS (Sustainable drainage Systems) that is adopted by the council, water company, or management company
